Terms and Conditions of Sale

1. Description of the service

Almacarta is a platform for creating premium digital invitations. The service lets users create a personalized mini-site for their events (wedding, engagement, aqiqa, birthday, etc.) including RSVP, programme, photo gallery and sharing via WhatsApp or QR code.

2. Pricing and payment

Current prices are as follows:

  • Classique Pack: 65 USD (one-time payment)
  • Premium Pack: 80 USD (one-time payment)
  • Prestige Pack: 100 USD (one-time payment, available soon)

Payment is made once by bank card (Visa, Mastercard, American Express) through the payment platform Stripe. No subscription is required. The invitation remains active indefinitely after payment.

Payment is made in US dollars (USD). The amount shown is the final amount, all taxes included.

3. User obligations

By using Almacarta, the user agrees to:

  • Provide accurate and truthful information
  • Not use the service for unlawful or defamatory purposes, or purposes contrary to public order
  • Not upload content that infringes third-party rights (photos, texts, music)
  • Respect the intellectual property rights of Almacarta and its templates

4. Intellectual property

Almacarta's templates, designs, animations, source code and creative content are protected by intellectual property law. The user is granted a licence limited to the scope of their event. Any reproduction, redistribution or resale of the templates is strictly prohibited.

Personalized content (texts, photos) uploaded by the user remains their property. Almacarta claims no rights over this content.

5. Limitation of liability

Almacarta is committed to providing a quality service; however:

  • Almacarta does not guarantee 100% service availability and cannot be held liable for temporary technical interruptions
  • Almacarta cannot be held liable for content uploaded by users
  • Almacarta's liability is limited to the amount of the pack purchased by the user

6. Refund policy and right of withdrawal

Almacarta provides digital content with immediate delivery: the invitation is generated, activated and put online as soon as payment is confirmed. Users can fully preview their invitation before paying.

6.1 Before the invitation is generated

As long as the invitation has not been generated or published, users may cancel their order and receive a full refund. Requests should be sent by email to contact@almacarta.com, stating the account email address and the payment reference.

6.2 After generation or publication

In line with the nature of the service, the right of withdrawal does not apply to digital content whose delivery has begun with the user's prior consent. Consequently, once the invitation has been generated, delivered or published, no refund is possible. By proceeding with payment, the user expressly acknowledges and accepts this immediate delivery and the corresponding loss of the right of withdrawal.

6.3 “Custom” option (made-to-measure design)

The “Custom” option is a bespoke design service crafted by hand within an indicative timeframe of two working days. As this is a service produced specifically at the user's request:

  • Cancellation with a full refund remains possible as long as the design work has not started.
  • Once the bespoke design has begun, a partial refund may be granted, less the work already completed.
  • Once the design has been delivered and approved, no refund is possible.

6.4 Process and timeframes

Any eligible refund request must be sent to contact@almacarta.com. Approved refunds are issued via the original payment method (Stripe), generally within fourteen (14) days of the request being accepted; the actual crediting time depends on the user's bank.

You can upgrade from the Classique pack to the Premium pack by paying the price difference; this difference is subject to the same refund policy described above.

7. Governing law and jurisdiction

These terms and conditions of sale are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to conflict-of-law rules. In the event of a dispute, the parties undertake to seek an amicable solution first. Failing agreement, any dispute relating hereto shall be subject to the exclusive jurisdiction of the competent courts of the State of Wyoming (Sheridan County), United States of America.
